Practice Areas and Groups

Davis Malm has seven core areas of practice: Business, Employment, Intellectual Property, Litigation, Real Estate and Environmental, Regulatory and Administrative Law, and Trusts and Estates.

The firm’s business lawyers are involved on a day-to-day basis in all matters, from international acquisitions for a NYSE-traded client to working with entrepreneurs in life sciences and technology who are licensing technologies from MIT, Harvard, and other centers of learning.

Davis Malm’s employment lawyers provide a broad range of services to employers of all sizes, including counseling on complex day-to-day issues and employment regulations and litigating discrimination and employment related disputes. The practice group also specializes in representing senior level executives in negotiating employment and separation agreements.

The firm’s intellectual property lawyers counsel companies and individuals in a wide range of industries and technology verticals on patent prosecution, obtaining and managing trademarks and copyrights, safeguarding trade secrets, negotiating and drafting licensing and joint venture agreements, preparing opinions, and enforcing and defending IP rights and assets through litigation.

Davis Malm’s litigators have extensive experience handling and resolving controversies of all sizes and complexity, from large and multifaceted litigation for major, publicly traded companies to “bet the company” litigation for smaller, privately held enterprises and individuals.

Since the firm’s inception, it has been a leader in real estate and environmental law, first in Massachusetts and New England and more recently nationally. They represent clients in all aspects of residential, commercial, and industrial acquisition, sale, financing, development, and leasing matters. They advise our clients on environmental laws and regulations in connection with real estate matters and have a strong record representing clients facing contamination issues, whether they are regulatory compliance or cost recovery and Superfund claims. They also often assist foreign nationals investing in U.S. real estate and provide information on the important tax aspects of investing in Massachusetts residential real estate.

Davis Malm’s regulatory and administrative law lawyers work with clients in regulated industries to ensure compliance and avoid or minimize sanctions in cases of alleged noncompliance. They also counsel clients in securing regulatory approvals and advocating in state and federal agency proceedings.

The firm’s Trusts and Estates lawyers assist clients to accomplish financial and charitable goals and to plan for the orderly disposition of assets. Of particular note is the firm’s experience in international estate planning and estate administration, advising both U.S. citizens living abroad and non-U.S. citizen residents with business or other assets in the U.S.
